Jury awards woman $861,000

Louisa—A jury last week awarded a South Williamson woman $861,178.08 in damages for personal injuries and medical expenses following a three-day jury trial in a medical malpractice case in Lawrence Circuit Court.

            Sofia Savage, and her husband, Roger Savage, filed the lawsuit against Tree Rivers Medical Center, alleging that Sofia Savage discovered in May 2005 that hospital staff had left a surgical sponge in her abdomen after a hysterectomy at the Louisa facility in December 2001.

            Sofia Savage complained in her lawsuit that the hospital had committed medical malpractice by failing to keep an adequate count of surgical equipment after her surgery and left the surgical sponge in her body for years.

            “The sponge had been retained within her body for over three years and was not discovered by doctors until Mrs. Savage complained of severe abdominal pain in 2005,” said Louisa attorney Mike Hogan, who assisted the Savages’ lawyers in the case.  “After her complaints of pain to her family doctor, Dr. Jeremy Klein, he ordered an upper GI screen to determine the source of her medical complaint.  It was then determined from the upper GI scan that the sponge was located within her abdomen.  Dr. Mark Pack performed emergency surgery the next day to remove the sponge.  However, by then, the sponge had become adhered and meshed to her intestines and bowels.  Expert witnesses testified that the sponge was attached to the organs like super glue and the removal of over 49cm’s of her intestines was necessary in order to remove the sponge.  Mrs. Savage testified that she still suffers from the effects of that surgery to day.  Experts agreed that her medical condition is permanent.”

            According to Hogan, TRMC attorney Sean Ragland argued during the trial that the sponge was left in Sofia Savage’s body from one of two earlier abdominal surgeries—a caesarean section performed in 1978 and a gallbladder removal in 1982. 

            Hogan said x-rays from 1993 showed there was no sponge in her body at that time.  Both plaintiff and defense experts agreed that surgical sponges are intentionally manufactured with a radioactive strip so they are easily seen by an x-ray.  The 2001 hysterectomy at TRMC was performed by Dr. Curt Edens, but all parties agreed that Edens was not responsible for the surgical sponge count from the hospital staff, Hogan said.

            “Now, Mrs. Savage will have money to pay for necessary medical care and to compensate her for what she went through.” Hogan said.

            The Savages were represented by H. Truman Chaffin and Tish Chaffin of Williamson, W.Va., who were assisted by Hogan.

            Heidi Maynard, TRMC’s risk management manager, said hospital officials could not comment on pending litigation.

            Attempts to reach Ragland for comment were unsuccessful.  It is not known if the hospital will appeal the jury’s verdict.

Firm Settles Coal Truck Accident Case in Federal Court

May, 2007- The law firm of Hogan and Robinson recently settled a coal truck accident that will give two young children trust funds to pay for college and help with future medical expenses. The case was filed under a special federal law called the Federal Motor Carrier Safety Act that imposes strict rules and regulations for commercial vehicles. The case was settled in federal court in Huntington, West Virginia.

SAVE Program Hosts "In God We Trust" Ceremony

April, 2007- The Lawrence County Attorney's Office in conjunction with the SAVE Program hosted a dedication ceremony to celebrate 400 years of religious freedom in America by posting the National motto "In God We Trust" on the wall of the Lawrence County Courthouse. County Attorney Michael Hogan, senior partner of Hogan & Robinson, said "I appreciate all the work the SAVE Program does on behalf of our community. I'm proud to be associated with so many good people who work to fight drug addiction in our community."

Hogan Re-elected Lawrence County Attorney

November, 2006- The attorneys and staff of Hogan & Robinson PLLC join in congratulating Partner Michael T. Hogan on winning re-election as Lawrence County Attorney. This will be Hogan's second term as county attorney. Asked about his re-election, Hogan replied, "It is an honor for me to serve the people of Lawrence County. Firm Settles $100,000 Car Accident Case

May 2006-Though the law firm of Hogan & Robinson, PLLC are ready to go to trial and litigate their clients' cases, their pre-suit negotiations has once again allowed them to recover policy limits  for one of their clients involved in an automobile accident.  The settlement was $110,000 and now their client, a high school student, will now have money for future medical bills and a trust fund that will pay for her college education.

November 2005-The firm of Hogan & Robinson PLLC once again has settled a case for a victim of a truck accident case to compensate them for their injuries. The total settlement was in excess of $500,000 and the client now will have resources for future medical bills and a college trust fund.
